After President-elect Barack Obama and the Democratic National Committee let a Dec. (1) deadline slip by without responding to Pennsylvania attorney Philip J. Berg's petition for writ of certiorari demanding Obama produce a legitimate birth certificate, the attorney is now filing a motion to stop Obama from taking office in January.

Berg has filed an emergency motion for immediate injunction, America's Right blogger and legal writer Jeff Schreiber reports. Berg is asking the court to stop state certification of electors to keep the Electoral College from meeting Dec. 15 and casting votes for Obama. He is also seeking to postpone the official vote count Jan. 6 until the court reaches a decision on his appeal.
Where's the proof Barack Obama was born in the U.S. and thus a "natural-born American" as required by Article 2, Section 1 of the Constitution? If you still want to see it, sign WND's petition demanding the release of his birth certificate.
The Constitution Still Matters
"It is my firm belief, my one thousand percent firm belief," Berg told Schreiber, "that he does not meet the natural born qualifications, that he should not be voted for by the electors, and that he should not be sworn in this January unless he shows his credentials ... which he of course cannot, simply because he does not have them."
Berg filed his petition Oct. 30, and according to procedure, a response from the defendants was due yesterday. While the Federal Election Commission waived its right to respond to the complaint Nov. 18, there has been no word from Obama or the DNC.
The parties are not legally required to respond, and Berg said he doesn't expect them to do so. He believes the defendants will argue that he lacks standing.
"If they were going to respond, I get the feeling that it would have been in there by now," Berg told Schreiber. "The feeling may be that, if they respond, they could hold themselves out for perjury later on when we're successful. That's why, in the lower court, they just relied on a motion to dismiss based on standing. Here, they may not want to file an actual, specific response in the Supreme Court for fear they'll be held to it later."
Berg referenced nationwide efforts to demand Obama produce an original birth certificate.
"We're finding that there is a great interest across the United States," Berg said. "I've been on talk show after talk show, and the more the case is discussed, the more people are made aware of it and are disgusted by the fact that Obama just won't simply produce the credentials showing he's qualified. Hopefully, some authority will DEMAND IT."

Where can I find a copy of George Bush's "original vault copy" of his birth certificate? We can't even get a copy of his Texas driving record...it's been erased!

President Bush's copy of his Birth Certificate is available all over the internet, the reason I call Obama's a "Vault Copy" is because it's locked up in a vault at the Burea Of Vital Statistic's in Hawaii.
All he has to do is produce it like all other President's have done and this will all go away!

I dont know what this Berg guy does or has said in the past all I know is he is the first case to be heard today, and then there are Thousands of other cases to be brought before SCOTUS. As well as every state Obama won in.
If you listen to Live Plains Radio online you will find that 1 million 257,537 Pieces of mail that have just been delivered to the SCOTUS, things are happening fast and furious over there.
But then I guess over a million of us are nuts for wanting to make sure our next President is a Natural Born US Citizen and that we all havent been duped!
Marie, all the papers here in PA are printing stories of the Kenyan born president elect fraud. I may have been wrong about the Supreme court not hearing the case about the imposter. We'll see today. Remember; over 3/4 of registered voters did not vote for Kenyan born Barack Obama

I am listening to Plains Radio right now, and not only was he born in Kenya but Somehow Britain comes into this whole thing some how and Obama said for himself that his birth was governed by the British something act of 1948 and even if that's true he was still not a Natural Born American Citizen.

The Rocky Mountain News did in fact run an online article asserting that Barack Obama holds both American and Kenyan citizenship. The article was incorrect, and the paper removed the item from the article and ran a correction. The paper's editor, John Temple, formally apologized for the error in an Aug. 15, 2007, column. Neither the correction nor the apology has prevented the column from circulating across the Internet as part of the latest set of baseless rumors that Obama is ineligible to run for president.
There was a grain of truth to what the Rocky Mountain News reported, though understanding why requires a brief history lesson.
When Barack Obama Jr. was born on Aug. 4,1961, in Honolulu, Kenya was a British colony, still part of the United Kingdom's dwindling empire. As a Kenyan native, Barack Obama Sr. was a British subject whose citizenship status was governed by The British Nationality Act of 1948. That same act governed the status of Obama Sr.'s children:
British Nationality Act of 1948 (Part II, Section 5): Subject to the provisions of this section, a person born after the commencement of this Act shall be a citizen of the United Kingdom and Colonies by descent if his father is a citizen of the United Kingdom and Colonies at the time of the birth.
In other words, at the time of his birth, Barack Obama Jr. was both a U.S. citizen (by virtue of being born in Hawaii) and a citizen of the United Kingdom and Colonies (or the UKC) by virtue of being born to a father who was a citizen of the UKC.
Obama's British citizenship was short-lived. On Dec. 12, 1963, Kenya formally gained its independence from the United Kingdom. Chapter VI, Section 87 of the Kenyan Constitution specifies that:
1. Every person who, having been born in Kenya, is on 11th December, 1963 a citizen of the United Kingdom and Colonies or a British protected person shall become a citizen of Kenya on 12th December, 1963...
2. Every person who, having been born outside Kenya, is on 11th December, 1963 a citizen of the United Kingdom and Colonies or a British protected person shall, if his father becomes, or would but for his death have become, a citizen of Kenya by virtue of subsection (1), become a citizen of Kenya on 12th December, 1963.
As a citizen of the UKC who was born in Kenya, Obama's father automatically received Kenyan citizenship via subsection (1). So given that Obama qualified for citizen of the UKC status at birth and given that Obama's father became a Kenyan citizen via subsection (1), it follows that Obama did in fact have Kenyan citizenship after 1963. So The Rocky Mountain News was at least partially correct.
But the paper failed to note that the Kenyan Constitution prohibits dual citizenship for adults. Kenya recognizes dual citizenship for children, but Kenya's Constitution specifies that at age 21, Kenyan citizens who possesses citizenship in more than one country automatically lose their Kenyan citizenship unless they formally renounce any non-Kenyan citizenship and swear an oath of allegiance to Kenya.
Since Sen. Obama has neither renounced his U.S. citizenship nor sworn an oath of allegiance to Kenya, his Kenyan citizenship automatically expired on Aug. 4,1982.

Actually if this whole episode get's heard by SCOTUS it eliminates John McCain as well, because he was born in the Panama Canal Zone!

My immediate response to Marc would be that to understand Townhall is to understand that we represent a broad array of conservative voices and opinions. In fact, we do not even publish editorials or take editorial positions. What is more, clearly we have regular writers (Kathleen Parker, for example) who express viewpoints that I personally find absurd, offensive and often childish. Clearly some conservatives out there like her though -- so we still run her columns ...
This whole notion of Obama's birth certificate, however, is something I've been meaning to write about anyway, as I have grown very tired of seeing a few of our commenters dwell on this ridiculous rumor.
I am of the opinion that anyone advancing the notion that Obama is not a citizen, and thus not qualified to become president, is actually undermining the conservative cause. Sadly, this ridiculous "conspiracy theory" will only serve to undermine the legitimate attacks on Obama, by casting us all in the role of zealots.
All indications are that Obama was born in the state of Hawaii. His mother was clearly an American citizen. In many regards, Obama has more of a claim to be eligible for the presidency than did Barry Goldwater (born in the "Arizona territory"), George Romney (born in Mexico), or John McCain (born in the Panama Canal Zone)...
There are plenty of legitimate reasons to criticize Obama, but dwelling on this ridiculous notion will only serve to undermine them.
To answer Marc's question of whether or not this is a legitimate question to ask, I would only reply that this is a legitimate topic if you believe in free speech. Moreover, it is not racist, sexist, or vulgar -- just (in my opinion) very destructive and unhelpful to those who care about advancing the cause of conservatism...
