Inhofe Views Bin Laden Death Photos, Calls For Their Release

Jim Inhofe: "I am still requesting that they make it public," the senator said of photos of a slain Osama bin Laden.

U.S. Sen. Jim Inhofe R-OK on Wednesday viewed the death photos of Osama bin Laden and once again called on the Obama administration to release at least some of them to the public.

Inhofe described several of the images as "pretty grotesque."

"I am still requesting that they make it public," the Oklahoma Republican said.

Inhofe conceded that perhaps that release could be limited to the photos of bin Laden's body as it was being prepared for burial at sea.

He said those photos, taken aboard a ship, could make it easier for the public to identify the body as bin Laden's than those taken earlier at the compound where he was killed.

"Because I have heard on the radio a lot of people saying 'I won't believe it until I see it,''' Inhofe said ''If it takes that for closure, I would recommend it."

A senior member of the Senate Armed Services Committee, Inhofe said he was the first member of Congress to view the bin Laden death photos at CIA headquarters after the agency agreed to make them available to certain lawmakers.

He cited information received from other sources and explained his viewing of the photos was not necessary to convince him that bin Laden had been killed in a raid by Navy SEALs in Pakistan on May 1.

Still, Inhofe disagreed with President Barack Obama's decision not to release the photos.

U.S. Rep. Dan Boren, D-Okla., a member of the House Intelligence Committee, said Wednesday he also has made the decision to view the photos.

"I have supported the release of these pictures so that there is no question that he was in fact killed," Boren said.

"I understand the sensitivity of this issue and can see why some may have the opinion that we could do more harm than good by sending them to news outlets. It is my belief that we should always try to be transparent."

In an interview broadcast Sunday on CBS's "60 Minutes," Obama explained the decision not to release the photos.

"We've done DNA sampling and testing and so there is no doubt that we killed Osama bin Laden," the president said.

"It is important for us to make sure that very graphic photos of somebody who was shot in the head are not floating around as an incitement to additional violence or as a propaganda tool. That's not who we are."

Reps. Peter DeFazio (D-OR), Jim McDermott (D-WA) and Jay Inslee (D-WA) are crafting a letter to share with the House Democratic Caucus that would try to prevent the Speaker from bringing the tax bill to the floor.

They hope to get 60 signatures on their letter (which is still being drafted) and then force a vote in the caucus. DeFazio says he thinks that if a majority of House Democrats are against this compromise, they shouldn't bring it to the floor.

In other words, they are seeking a majority of the majority to move this and a senior House democratic source indicates they don't know if they have a majority of democrats, saying they haven't whipped this yet.

In an interview with Fox, DeFazio criticizes the president and says a majority of the House Democratic Caucus does not support the tax rate compromise. "There does not seem to be a majority of the Democrats who support the deal negotiated by Vice President Biden," DeFazio said. "So we want to have a record vote in the caucus on a resolution that says this resolution should not go to the floor without a majority of Democratic votes."

I am truly sorry I havent been around much in the last 2 years! In the last 2 years I have lost my Mother, My Father, And my Uncle all in the same time frame.

Then I had to go to California take care of my Dad as he was dying, and still trying to maintain a life in Oklahoma where my Family is. Then I had to deal with selling my parents house and trying to move everything back to Oklahoma.

I also had to deal with alot of Law stuff and my Mental as well as Physical Health.

I had to have Major Surgery in the past few months and I have been trying to heal over that.

But on the brighter side I am beginning to feel better and I will be back in the game and posting alot more and soon.

I dont know what else to say except bare with me. I will go around and visit all my friends and try to catch up.

HILLSBOROUGH, N.H. -- A Navy veteran is fighting to be able to show his patriotism by flying an American flag outside his apartment building.

Joe LeVangie, 88, said he's upset after he and his neighbors were told to take their flags down because flying them was against management policy. He said there should be an exception for the flag.

LeVangie, a World War II veteran, said he used to fly his American flag outside his apartment at the Maple Leaf complex in Hillsborough.

"In respect for all the troops serving overseas now and for those who never came back," he said.

But recently, his management company told all residents that their flags had to come down. The brackets for the flag poles were also removed.

"I was madder than hell," he said. "Come to find out, it was the maintenance man who was told to do so."

The same thing happened to Margery Kenney, who lives next door. Her brackets were taken down, and her flag is now rolled up against the wall.

"My whole family was in the service, and it's a shame something like this was allowed to happen," she said.

EJL Management said the flags violate a blanket policy prohibiting such displays. A letter sent to LeVangie said a letter sent to him by the company said it was part of a policy that also prohibits lawn ornaments and grills.

The company said that to honor residents' patriotism, a flag was placed at the entrance of Maple Leaf. But LeVangie said a single flag is not enough.

"Why should it be sufficient?" he said. "Is the one in Concord sufficient for the state of New Hampshire?"

LeVangie's rent is subsidized by the federal government. A representative from the Department of Housing and Urban Development said EJL is complying with the Freedom to Display the American Flag Act of 2005.

HILLSBOROUGH, N.H. -- A Navy veteran in Hillsborough will now be allowed to fly his U.S. flag outside his apartment building.

Hillsborough police said an agreement has been reached to allow residents of the Maple Leaf Village complex to fly flags.

Joe LeVangie, 88, and his neighbors had been told to take down the flags because they were displayed in violation of a policy set by the management company. LeVangie is a World War II veteran and said he flew his flag to honor troops serving overseas.

Police said that under a preliminary agreement reached with management company EJL Management, the Hillsborough Police Association in partnership with American Legion Post 59 agreed to keep an eye on the flags and make sure they are in good condition. If not, the police association will talk to the owner of the flag to see if it can be replaced.

If the owner can't replace it, the police association will cover the cost to replace the flag at no cost to the town or owner of the rental property.

Police said all parties are in agreement, and the details will be worked out with the property custodian.

LeVangie's story gained national attention after it was first reported on News 9. Many viewers who saw the story on-air or online said they were shocked by the order to remove the flag.

Power Play Over Immigration Law:

LA's boycott resolution sparks a threat over power the city receives from Arizona

An Arizona utility commissioner said he's willing to pull the plug on Los Angeles if the city goes through with a boycott of his state.

In a letter to the city of LA, a member of Arizona's power commission said he would ask Arizona utility companies to cut off the power supply to Los Angeles. LA gets about 25 percent of its power from Arizona.

"That is one commissioner who has that idea whether he can do that or not is another idea," said LA Councilman Dennis Zine. "They are the ones who have to make the move, not us."

The commissioner's power grid play is in response to the city's approval of a resolution directing city staff to consider which contracts with Arizona can be terminated.

Can Arizona Pull the Plug?

"If an economic boycott is truly what you desire, I will be happy to encourage Arizona utilities to renegotiate your power agreements so Los Angeles no longer receives any power from Arizona-based generation.

If, however, you find that the City Council lacks the strength of its convictions to turn off the lights in Los Angeles and boycott Arizona power, please reconsider the wisdom of attempting to harm Arizona’s economy.

Mayor Antonio Villaraigosa is in Washington D.C., meeting with Mexican President Felipe Calderon, but his deputy chief of staff issued the following statement: "The mayor stands strongly behind the city council and he will not respond to threats from the state that has isolated itself from an America that values freedom, liberty and basic civil rights."

Councilmember Tom LaBonge said he'd like to talk with Pierce. LaBonge said the city needs to look into its long standing utility agreements with Arizona.

Other California cities, including Oakland and San Francisco, have passed similar measures.

On Tuesday, Berkeley became the latest California city to boycott Arizona. The City Council voted unanimously to restrict staff from traveling to the state on city business.

SB 1070 -- here's the text of the law -- empowers local law enforcement to check the immigration status of suspects they have stopped for other reasons if there is a reasonable suspicion they are in the country illegally. The law specifically bars police from racial profiling.

The Arizona Republic newspaper recently asked a panel of experts to outline how the law would work in real-world situations. The experts' interpretations varied when it came to what happens at the point a law encforcement officer can or should ask about a person's status.

Rush Limbaugh Say's: He's Fine!

HONOLULU -- Radio talk show host Rush Limbaugh said he's fine and leaving the hospital with plans to return to work on Wednesday. The combative conservative said tests show nothing wrong after he was hospitalized with chest pains.

He remained at a hospital in Hawaii Thursday night, a day after being admitted for chest pains.

According to his radio program, Limbaugh underwent a complete examination on Thursday that gave doctors more information about his condition.

Walter E. Williams, who filled in for Limbaugh on his radio show, offered a brief update on the host's condition.

"Rush continues to rest very comfortably in the hospital in Honolulu this afternoon," Williams said.

Limbaugh was in Hawaii for a Christmas vacation. He was spotted golfing earlier in the week at the Waialae Country Club.

On Wednesday, he was taken from the Kahala Hotel and Resort to Queens Medical Center after complaining of chest pains.

"Those pains were the kind of pains that makes one feel like he has a heart attack coming on, but it's not been confirmed that it was a heart attack," Williams said. "Rush is in good and stable condition. (He's) comfortable, as comfortable as one can be in a hospital while on vacation and he's in good hands."

On Friday, Limbaugh held a conference to brief reporters at the Cardiac Comprehensive Care Unit of the hospital.

"I experienced pain in my upper left chest like I had never felt before," Limbaugh said. (Video: Watch the entire interview.)

He said the pain was real but he still doesn't know what caused it.

Limbaugh said an angiogram found nothing wrong and that he's never had heart problems.

"Best guess," Limbaugh said, "it might have been a spasm in an artery."

"The treatment I received here was first rate," he said, thanking the doctors, nurses and nurses aides at Queen's Medical Center in Honolulu.

Limbaugh checked out of the hospital after his news conference. He said he would return to work on Wednesday, a two-day delay because of his hospitalization.

His insistence of a preliminary report on investigators’ initial findings by Thursday will also go some way to suggestions that the president is gaining a reputation for taking his time to consider before making security decisions.

Security has been tightened at airports across the US and the Federal Bureau of Investigation is conducting an inquiry into how the incident happened.

The American People have been emboldened by the administration’s faltering response to the attempted attack. Janet Napolitano, the homeland security secretary, on Sunday said “the system worked” but later performed a U-turn, saying that it did not work and “no one is happy with that”, comments that were reinforced by Mr Obama on Tuesday.

Peter Hoekstra, a congressman from Michigan and ranking Republican of the House intelligence committee, said the suspect should have had a red flag next to his name.

“You would have thought this would go right to the top of the list,” Mr Hoekstra told CBS on Tuesday. “This threat is real . . . We need to be on offence.”

Americans traditionally perceive Republicans to be strong on national security issues.

In 2007, the Academy sanctified Gore's cinematic message of global warming with its famous statue, enriched his earnings by $100,000 per 85-minute appearance and helped elevate the Tennessean's profile to win the Nobel Peace Prize despite losing the election battle of 2000 to a Texan and living in a large house with lots of energy-driven appliances.

The demand to withdraw Gore's award provides yet another opportunity to argue.

The startling leak comes at an inconvenient time, just before next week's United Nations climate change meeting, which will cause an immense carbon footprint with thousands of people flying up or over to Denmark to talk about saving the environment.

These airplanes will include Air Force One with its primary passenger, President Obama, who's returning to the Copenhagen scene where he didn't help win the 2016 Summer Olympics for Chicago, which could do with a little global warming at this time of year.

“Every Republican member of the House chose to take Rush Limbaugh’s advice,” says the narrator after playing the conservative talk radio giant’s declaration that he hopes Obama “fails.”

“Every Republican voted with Limbaugh — and against creating 4 million new American jobs. We can understand why a extreme partisan like Rush Limbaugh wants President Obama’s Jobs program to fail — but the members of Congress elected to represent the citizens in their districts? That’s another matter. Now the Obama plan goes to the Senate, and the question is: Will our Senator"—here the ad is tailored by state to name George Voinovich in Ohio, Arlen Specter in Pennsylvania, and John Ensign in Nevada—"side with Rush Limbaugh too?”

Asked to respond, Limbaugh had a message for his party.

“Senate Republicans need to understand this is not about me,” he wrote in an email. “It is about them, about intimidating them, especially after the show of unity in House. The Democratic Congressional Campaign Committee has launched an online petition to express outrage at conservative radio host Rush Limbaugh for saying he wanted President Obama to "fail."

"Jobs, health care, our place in the world the stakes for our nation are high and every American needs President Obama to succeed," the petition reads. "Stand strong against Rush Limbaugh's Attacks sign our petition, telling Rush what you think of his attacks on President Obama."

The petition comes after Obama warned Republicans on Capitol Hill Friday that they need to quit listening to Limbaugh if they want to get along with Democrats and the new administration.

"You can't just listen to Rush Limbaugh and get things done," he told top GOP leaders, whom he had invited to the White House to discuss his nearly $1 trillion stimulus package.

One White House official confirmed the comment but said he was simply trying to make a larger point about bipartisan efforts.

On Monday, Limbaugh shot back at Obama, opening his show by saying, "I'm the man you should not be listening to, according to President Obama."

"I think [Obama] wants me to fail," Limbaugh said. "He's more frightened of me than he is of John Boehner, which doesn't say much for our party."

The remarks came after Limbaugh said last week on his radio show: "If I wanted Obama to succeed, I'd be happy the Republicans have laid down. I don't want this to work. So I'm thinking of replying to this guy, say 'okay, I'll send you a response, but I don't need 400 words, I need four: I hope he fails'."

The committee's online petition includes a YouTube video featuring audio clips of the radio host's recent remarks.

The postmortems on the presidency of George W. Bush are all wrong. The liberal line is that Bush dangerously weakened America's position in the world and rushed to the aid of the rich and powerful as income inequality worsened. That is twaddle. Conservatives--okay, not all of them--have only been a little bit kinder. They give Bush credit for the surge that saved Iraq, but not for much else.

He deserves better. His presidency was far more successful than not. And there's an aspect of his decision-making that merits special recognition: his courage. Time and time again, Bush did what other presidents, even Ronald Reagan, would not have done and for which he was vilified and abused. That--defiantly doing the right thing--is what distinguished his presidency.

Bush had ten great achievements (and maybe more) in his eight years in the White House, starting with his decision in 2001 to jettison the Kyoto global warming treaty so loved by Al Gore, the environmental lobby, elite opinion, and Europeans. The treaty was a disaster, with India and China exempted and economic decline the certain result. Everyone knew it. But only Bush said so and acted accordingly.

He stood athwart mounting global warming hysteria and yelled, "Stop!" He slowed the movement toward a policy blunder of worldwide impact, providing time for facts to catch up with the dubious claims of alarmists. Thanks in part to Bush, the supposed consensus of scientists on global warming has now collapsed. The skeptics, who point to global cooling over the past decade, are now heard loud and clear. And a rational approach to the theory of manmade global warming is possible.

Second, enhanced interrogation of terrorists. Along with use of secret prisons and wireless eavesdropping, this saved American lives. How many thousands of lives? We'll never know. But, as Charles Krauthammer said recently, "Those are precisely the elements which kept us safe and which have prevented a second attack."

Crucial intelligence was obtained from captured al Qaeda leaders, including 9/11 mastermind Khalid Sheikh Mohammed, with the help of waterboarding. Whether this tactic--it creates a drowning sensation--is torture is a matter of debate. John McCain and many Democrats say it is. Bush and Vice President Cheney insist it isn't. In any case, it was necessary. Lincoln once made a similar point in defending his suspension of habeas corpus in direct defiance of Chief Justice Roger Taney. "Are all the laws but one to go unexecuted, and the government itself go to pieces, lest that one be violated?" Lincoln asked. Bush understood the answer in wartime had to be no.

Bush's Third achievement was the rebuilding of presidential authority, badly degraded in the era of Vietnam, Watergate, and Bill Clinton. He didn't hesitate to conduct wireless surveillance of terrorists without getting a federal judge's okay. He decided on his own how to treat terrorists and where they should be imprisoned. Those were legitimate decisions for which the president, as commander in chief, should feel no need to apologize.

Defending, all the way to the Supreme Court, Cheney's refusal to disclose to Congress the names of people he'd consulted on energy policy was also enormously important. Democratic congressman Henry Waxman demanded the names, but the Court upheld Cheney, 7-2. Last week, Cheney defended his refusal, waspishly noting that Waxman "doesn't call me up and tell me who he's meeting with."

Negroponte and almost 1,000 invited guests looked on as the embassy's Marine security detachment raised the red, white and blue over the largest U.S. Embassy in the world, with the Army's 4th Infantry Division Band playing the U.S. national anthem.

The compound, set on 104 acres along the banks of the Tigris River in central Baghdad, includes 27 modern office, housing and support buildings in tones that blend with the desert landscape. Officials said the scale of the new complex reflects the importance of the U.S.-Iraqi bilateral relationship.

More than 1,200 U.S. diplomats, servicemembers and government officials and staff from 14 federal agencies will work and live on the compound, embassy officials said. Their tasks and missions run the gamut: supporting local elections, helping to fight corruption, helping develop Iraq's energy and transportation sectors, strengthening the rule of law, providing security training and promoting educational and cultural exchange. In addition, 240 servicemembers assigned to Multinational Force Iraq are based at the embassy.

Talabani called the new building a sign of how far the U.S.-Iraqi relationship has come.

"This building is not only a compound for the embassy, but a symbol of the deep friendship between the two peoples of Iraq and America," he said.

President-elect Barack Obama is naming Leon Panetta, a former congressman from California and chief of staff to President Bill Clinton, to be CIA director. Obama also has picked retired Navy Admiral Dennis Blair to be director of national intelligence, overseeing all the nation's spy agencies, a Democratic official said.

The selection pairs a top military man with a quintessential Washington insider - but that combination appeared to irk some key Senate Democrats, who expressed concern that Panetta does not have an intelligence background. “My position has consistently been that I believe the agency is best-served by having an intelligence professional in charge at this time,” said California Sen. Diane Feinstein, who will oversee Panetta's confirmation as chair of the Select Committee on Intelligence.

Sen. Kit Bond (R-Mo.), the vice chairman of the committee, also questioned the choice of Panetta. “Job number one at the CIA is to track down and stop terrorists. In a post-9-11 world, intelligence experience would seem to be a prerequisite for the job of CIA Director. While I will reserve final judgment on President-elect Obama’s nomination for the leader of our terror-fighting agency, I will be looking hard at Panetta’s intelligence expertise and qualifications."

Cornyn Rips Reid On Blago Calls

A top Senate Republican is criticizing Harry Reid's involvement in the Illinois Senate seat scandal, accusing him of meddling in the state's affairs by pushing certain candidates in phone calls to Gov. Rod Blagojevich.

Sen. John Cornyn of Texas, chairman of the National Republican Senatorial Committee, said Reid "has led the charge to deny the people of Illinois a voice" in the process. To be sure, Republicans like Cornyn would rather see a special election in Illinois because it would give the GOP a shot at capturing the seat.

According to a Chicago Sun-Times report Saturday, Reid called Blagojevich on Dec. 3 and urged him to tap either state Veteran Affairs Director Tammy Duckworth or state Attorney General Lisa Madigan, both Democrats, to fill the seat. Blagojevich was arrested less than a week later on corruption charges that included allegations he was trying to sell the seat to the highest bidder.

The paper also reported that Reid advised the Illinois governor against selecting state Senate President Emil Jones, a mentor of President-elect Barack Obama, or Reps. Jesse Jackson Jr. and Danny Davis —all of whom, Reid reportedly said, would face difficulty holding on to the seat when it is up for election in 2010.

"For the last several weeks, Senator Reid has led the charge to deny the people of Illinois a voice in choosing their next U.S. senator in a special election," Cornyn said in a Saturday afternoon statement. "Now we learn that Senator Reid also took the extraordinary step to lobby against two sitting U.S. congressmen and the state senate Majority Leader in Illinois, and instead told Governor Blagojevich that he supported an appointment for an individual [Duckworth] who recently lost a U.S. House election.

"The people of Illinois deserve a simple explanation from Senator Reid: Why does he believe these three Illinois officeholders are 'unelectable' to the U.S. Senate?" Cornyn added.

Dingey Harry Reid To Have Burris Blocked By Sgt. Of Arms At Senate Door!

Senate Majority Leader Harry Reid said on Sunday that "legal authority" exists under the Constitution to bar embattled Illinois Gov. Rod Blagojevich's pick to fill President-elect Barack Obama's vacant Senate seat, but added there is also room to negotiate.

Under the Constitution, Reid said, "We determine who sits in the Senate. And the House (of Representatives) determines who sits in the House. So there's clearly legal authority for us to do whatever we want to do. This goes back for generations."

Speaking on NBC's "Meet the Press," Reid said he plans to meet on Wednesday with Blagojevich's choice for the Senate, Roland Burris, 71, the former Illinois attorney general, a fellow Democrat.

Asked if there was room for a possible settlement, Reid said, "I'm an old trial lawyer. There is always room to negotiate."

New members will be sworn in on Tuesday with the opening of the new Congress.

Reid called Burris a "tainted appointment" because of the governor's alleged misconduct, although he said he did not know of anything wrong with Burris himself.

Blagojevich, who was arrested on December 9 and accused of trying to sell Obama's vacant seat, is facing impeachment in the Illinois legislature in the state capital of Springfield. Blagojevich has denied the corruption charges and has refused demands by Obama and others to resign as governor.

Reid said he planned to meet on Monday to discuss the matter with Senate Republican Leader Mitch McConnell. "I hope we can solve this issue on a bipartisan basis," Reid said.

Asked if Burris will become a U.S. senator, Reid said, "It will be very difficult for that to occur." But he added, "Anything can happen.

Democrats Vow to Block Blagojevich Senate Appointment

Illinois Gov. Rod Blagojevich named former state Attorney General Roland Burris to fill President-elect Barack Obama's vacant U.S. Senate seat on Tuesday, stunning lawmakers both in his home state and in Washington, where Senate Democrats vowed to block the appointment.

Illinois Secretary of State Jesse White, who must certify the appointment, said he will not do so and Senate leaders reiterated that they would not accept anyone appointed by Blagojevich.

Blagojevich, claiming he was obligated by law to fill the vacant Senate seat, called Burris -- a lobbyist and campaign donor to the governor -- a candidate of "unquestioned integrity" and urged the public not to "allow the allegations against me to taint this good and honest man."

"It is truly regrettable that despite requests from all 50 Democratic Senators and public officials throughout Illinois, Gov. Blagojevich would take the imprudent step of appointing someone to the United States Senate who would serve under a shadow and be plagued by questions of impropriety," Senate Democrats said in a written statement.

Obama sided with the Senate leadership, saying in a written statement that the governor's decision was "disappointing" and that he should resign so a "lawful and appropriate process of succession" can take place.

The complaint states Blagojevich wanted a promise of a high-level appointment or some other reward for Blagojevich in exchange for Blagojevich naming Obama’s friend Valerie Jarrett to replace him in the U.S. Senate.

Emanuel was uncharacteristically absent from Obama’s news conference this morning. He was spotted two hours later in the lobby of Chicago’s City Hall. He was there to listen to his two children performing in a concert with their school, Anshe Emet.

A Sun-Times reporter pressed him to comment about whether he was the emissary named in the criminal complaint.

“You’re wasting your time,” Emanuel said. “I’m not going to say a word to you. I’m going to do this with my children. Don't do that. I’m a father. I have two kids. I’m not going to do it.”

Asked, “Can’t you do both?” Emanuel replied, “I’m not as capable as you. I’m going to be a father. I’m allowed to be a father,” and he pushed the reporter’s digital recorder away.

Blagojevch was caught on tape saying that he wanted the Obama advisor in question to know what Blagojevich wanted in exchange for the Jarrett appointment.

Blagojevich said, “He asks me for the fifth CD thing, I want it to be in his head.” Emanuel represents the 5th Congressional District in Illinois.

Sources Say Rep. Jesse Jackson Jr. Is 'Senate Candidate No. 5'

Chicago Rep. Jesse Jackson Jr., D-Ill., is the anonymous "Senate Candidate No. 5" whose emissaries Illinois Gov. Rod Blagojevich reportedly offered up to $1 million to name him to the U.S. Senate, federal law enforcement sources tell ABC News.

The politician says he is not a target of the Blagojevich investigation.
According to the FBI affidavit in the case, Blagojevich "stated he might be able to cut a deal with Senate Candidate 5 that provided Rod Blagojevich" with something "tangible up front."

Jackson said this morning he was contacted Tuesday by federal prosecutors in Chicago whom he said "asked me to come in and share with them my insights and thoughts about the selection process."

Jackson said, "I don't know" when asked whether he was Candidate No. 5, but said he was told "I am not a target of this investigation."

Jackson said he agreed to talk with federal investigators "as quickly as possible" after he consulted with a lawyer.

Illinois Gov. Rod Blagojevich-D was arrested on Tuesday on charges that he brazenly conspired to sell or trade the U.S. Senate seat left vacant by President-elect Barack Obama to the highest bidder.

Blagojevich also was charged with illegally threatening to withhold state assistance to Tribune Co., the owner of the Chicago Tribune, in the sale of Wrigley Field, according to a federal criminal complaint. In return for state assistance, Blagojevich allegedly wanted members of the paper's editorial board who had been critical of him fired.

A 76-page FBI affidavit said the 51-year-old Democratic governor was intercepted on court-authorized wiretaps over the last month conspiring to sell or trade the vacant Senate seat for personal benefits for himself and his wife, Patti.

Otherwise, Blagojevich considered appointing himself. The affidavit said that as late as Nov. 3, he told his deputy governor that if "they're not going to offer me anything of value I might as well take it."

"I'm going to keep this Senate option for me a real possibility, you know, and therefore I can drive a hard bargain," Blagojevich allegedly said later that day, according to the affidavit, which also quoted him as saying in a remark punctuated by profanity that the seat was "a valuable thing _ you just don't give it away for nothing."

A former Illinois bank official, now claiming whistleblower status, says bank officials replaced a loan reappraisal that he prepared for a Chicago property that was purchased by the wife of now-convicted felon Tony Rezko (Obama Donor), part of which was later sold to next-door neighbor Barack Obama.

In a complaint filed Thursday in the Circuit Court of Cook County, Kenneth J. Connor said that his reappraisal of Rita Rezko's property was replaced with a higher one and that he was fired when he questioned the document.

Mr. Connor, a real estate and commercial credit analyst at the Mutual Bank Corp. in Chicago, also noted in the complaint that the bank received a grand jury subpoena in October 2006 requiring it to produce information concerning Mrs. Rezko's purchase, including the bank's files on the property.

NEW ORLEANS - In a year when national Republican fortunes took a turn for the worse, Louisiana delivered the GOP two seats in Congress in elections delayed by Hurricane Gustav.

Indicted Democratic U.S. Rep. William Jefferson was ousted Saturday from his New Orleans area district, while Republicans narrowly held on to the seat vacated by a retiring incumbent.

Charlie Rangel's perch as the chairman of the mighty House Ways and Means Committee is in danger. Supposedly.

The 78-year-old Harlem Democrat, a fixture on Capitol Hill since 1971, has been the subject of a stream of revelations about potential financial and ethical improprieties, the sort of never-ending scandal that would pose a serious threat to his electability if he represented a marginally competitive district. But New York's 15th District is tailor-made for an entrenched Democratic incumbent to stay in office as long as he wants, so Rangel need not fear the wrath of the voters.

The only real threat to a congressional lifer like Rangel is internal, from within the ranks of his fellow Democrats in the U.S. House. If they want to strip him of his powerful Ways and Means gavel, they can. And, technically, that is what they are now mulling, with the House Committee on Standards of Official Conduct -- otherwise known as the ethics committee -- set to report back on his supposed misdeeds just before the new Congress convenes in early January. But don't hold your breath waiting for any drama.

After President-elect Barack Obama and the Democratic National Committee let a Dec. (1) deadline slip by without responding to Pennsylvania attorney Philip J. Berg's petition for writ of certiorari demanding Obama produce a legitimate birth certificate, the attorney is now filing a motion to stop Obama from taking office in January.

Berg has filed an emergency motion for immediate injunction, America's Right blogger and legal writer Jeff Schreiber reports. Berg is asking the court to stop state certification of electors to keep the Electoral College from meeting Dec. 15 and casting votes for Obama. He is also seeking to postpone the official vote count Jan. 6 until the court reaches a decision on his appeal.

Where's the proof Barack Obama was born in the U.S. and thus a "natural-born American" as required by Article 2, Section 1 of the Constitution? If you still want to see it, sign WND's petition demanding the release of his birth certificate.

The Constitution Still Matters

"It is my firm belief, my one thousand percent firm belief," Berg told Schreiber, "that he does not meet the natural born qualifications, that he should not be voted for by the electors, and that he should not be sworn in this January unless he shows his credentials ... which he of course cannot, simply because he does not have them."

Berg filed his petition Oct. 30, and according to procedure, a response from the defendants was due yesterday. While the Federal Election Commission waived its right to respond to the complaint Nov. 18, there has been no word from Obama or the DNC.

The parties are not legally required to respond, and Berg said he doesn't expect them to do so. He believes the defendants will argue that he lacks standing.

"If they were going to respond, I get the feeling that it would have been in there by now," Berg told Schreiber. "The feeling may be that, if they respond, they could hold themselves out for perjury later on when we're successful. That's why, in the lower court, they just relied on a motion to dismiss based on standing. Here, they may not want to file an actual, specific response in the Supreme Court for fear they'll be held to it later."

Berg referenced nationwide efforts to demand Obama produce an original birth certificate.

"We're finding that there is a great interest across the United States," Berg said. "I've been on talk show after talk show, and the more the case is discussed, the more people are made aware of it and are disgusted by the fact that Obama just won't simply produce the credentials showing he's qualified. Hopefully, some authority will DEMAND IT."

Last chance for Constitution?

Most Americans don't realize it yet, but this Friday, the U.S. Supreme Court will review whether Barack Obama is indeed constitutionally eligible to become the next president.

The justices will hold a conference on the question and consider the case for formal review.

The case is brought by Leo C. Donofrio against Nina Wells, the New Jersey secretary of state, and questions whether Obama is a "natural-born citizen" as required by Article 2, Section 1 of the Constitution.

If four of the nine justices vote to hear the case in full, oral argument may be scheduled.

It would seem a simple matter to resolve.

Barack Obama could have put this issue to rest long ago by producing a complete birth certificate from Hawaii. Instead, he has chosen to stonewall the matter, citing a website post of what can only be characterized as a partial representation of a birth certificate – one that has been criticized as a forgery.

Whether the birth certificate posted on various websites is genuine or not is almost beside the point as to his eligibility. Since Hawaii was known to register foreign births in the 1960s, the portion of the certificate released by the Obama campaign proves nothing, since it does not reveal such details as the hospital in which he was allegedly born.

Meanwhile, some of Obama's own Kenyan relatives claim to have been present at his birth in Mombasa.

This controversy, which some have dismissed as frivolous, is as serious as the literal meaning of the Constitution itself.

As I have stated before, I have little doubt a thorough investigation will prove Obama is qualified to serve the office of the presidency as a "natural-born citizen." I don't believe his campaign would ever have been successful with the specter of legal ineligibility hanging over his head.

Nevertheless, I think it is imperative to be faithful to the Constitution and to offer the American people full disclosure on such a fundamentally important matter.

Clearly, Obama doesn't think so.

But what about our U.S. Supreme Court?

Do the justices have the courage to face up to this question?

I believe they will be much more likely to do so – to take this matter seriously – if they see real demonstrations of public interest. I know of no better way for you to show that interest than to sign WND's petition.

This petition was launched just over a week ago and now boasts more than 120,000 names.

All those signing it are receiving updates on controversy. The names will be delivered to the U.S. Supreme Court in time for its review Friday. This week will represent your last chance to impact that review.

Defense Secretary Robert Gates will keep the top Pentagon job for at least the first year of the Obama administration.

There was very strong support for Gates among Democrats, said one Democratic source in the Senate whose boss was intimately involved in bringing Obama and Gates together to see if they were compatible.

Obama's decision to keep Gates follows speculation, encouraged before the election by Obama's aides, that Gates would stay on for an interim period.

A registered independent, Gates has served various Republican administrations. President Bush nominated Gates to replace Donald Rumsfeld after the 2006 midterm elections, when the war in Iraq was descending into chaos and became a political liability for Republicans.

Gates will continue to preside over two U.S. wars, in Iraq and Afghanistan, that Bush launched as part of the larger war on terror.

There are several issues on which Gates and Obama disagree, including missile defense. Gates supports placing a missile defense system in Europe, but Obama already has suggested that he won't sign off on it until the technology has been proven capable.

A formal announcement is expected immediately after the Thanksgiving holiday weekend as part of an unveiling of the new national security team, which is expected to include Sen. Hillary Clinton as secretary of state; Marine Gen. Jim Jones as national security adviser, Admiral Dennis Blair as director of national intelligence and Susan Rice as U.S. ambassador to the United Nations.

Alan Keyes Now Suing To Prove President-Elect's Citizenship

A former opponent of Barack Obama's has come back to haunt him over questions regarding Obama's citizenship.

According to a press release from the American Independent Party, former presidential candidate Alan Keyes and other members of the party have filed suit in California Superior Court in Sacramento to stop the state from giving its electoral votes to President-elect Barack Obama until documentary evidence is provided to prove Obama is indeed a natural born citizen of the United States.

Some conservatives have questioned Obama's citizenship in recent months. Obama says he was born in Hawaii in 1961.

Keyes also ran against Obama as a Republican for the U.S. Senate seat in Illinois in 2004. Obama won that election to serve his first and only term in the U.S. Senate.

62. Article II, Section I of the United States Constitution, states, in pertinent part, as follows:
"No Person except a natural born citizen, or a citizen of the United States at the time of the
adoption of this constitution, shall be eligible to the Office of President;"
63. Senator Barack H. Obama is a candidate for the Office of the President of the United
States. However, to assume such office, Senator Obama must meet the qualifications specified for the
Office of the President of the United States, which includes that he must be a "natural born" citizen.
Senator Obama has failed to demonstrate that he is a "natural born" citizen. There are other legal
challenges before various state and federal courts regarding aspects of lost or dual citizenship concerning
Senator Obama. Those challenges, in and of themselves, demonstrate Petitioners’ argument that
reasonable doubt exists as to the eligibility of the Democratic Party’s nominee for President.
64. SOS is responsible for ensuring the validity of the State election process by, among other
things, verifying the qualifications of the voters, approving the ballots and the candidates, supervising the
counting of the ballots, and certifying the results. This certification of the vote by SOS, based upon
which Electors received the highest number of votes in the state, is the method provided for in California

law for ascertaining which Electors are appointed to vote for president (California Elections Code §
15505, 3 U.S.C. § 6). On December 1, or as soon as soon as the election results have been received from
all counties in the state, SOS shall certify the names of the ascertained Electors to the Governor, and then
transmit to each presidential Elector a certificate of election (California Elections Code § 15505). The
Governor then issues and seals a Certificate of Ascertainment which is delivered to the Electors by
December 15 (3 U.S.C. § 6), who then meet to sign the Certificate of Vote (Federal Election Code §
192.006). The office of SOS is intended to be non-biased and to provide the critical sense of fairness and
impartiality necessary for the people to have faith in the fundamental underpinnings of the democratic
basis for our elections.
65. There is a reasonable and common expectation by the voters that to qualify for the ballot,
the individuals running for office must meet minimum qualifications as outlined in the federal and state
Constitutions and statutes, and that compliance with those minimum qualifications has been confirmed by
the officials overseeing the election process. Heretofore, only a signed statement from the candidate
attesting to his or her meeting those qualifications was requested and received by SOS, with no
verification demanded. This practice represents a much lower standard than that demanded of one when
requesting a California driver’s license. Since SOS has, as its core, the mission of certifying and
establishing the validity of the election process, this writ seeks a Court Order barring SOS from certifying
the California Electors until documentary proof that Senator Obama is a “natural born” citizen of the
United States of America is received by her. This proof could include items such as his original birth
certificate, showing the name of the hospital and the name and the signature of the doctor, all of his
passports with immigration stamps, and verification from the governments where the candidate has
resided, verifying that he did not, and does not, hold citizenship of these countries, and any other
documents that certify an individual’s citizenship and/or qualification for office.
66. In the case of individuals seeking the Office of President of the United States, the United
States Constitution provides for a system of Electors, wherein citizens of the respective states have a state

controlled election in which Electors representing the interests of the respective candidates for President
on the state ballot are elected to represent the interests of the respective state in the Electoral College.
Thus, there is no federal ballot controlled by the federal government. There is a California State ballot
where voters elect Electors who in turn represent the named candidate for office on the ballot. That is one
more reason why SOS has responsibility for the certification of not just the counts of the ballots cast, but,
also, the propriety of the contents of the ballot. In case Senator Obama cannot present proper
documentation verifying his citizenship, he cannot be elected President of the United States, and SOS has
a duty to bar the casting of votes by California Electors in support of his candidacy.
67. To avert a constitutional crisis which would certainly accrue after the election through
laborious legal challenges, this writ seeks to resolve such complaints. It was incumbent on the candidates
to present the necessary documentation confirming his citizenship, but, to date, Senator Obama has failed
to do so.
68. At this point, Senator Obama has not allowed independent or official access to his vault
(original hospital) birth records and supporting hospital records. Senator Obama’s citizenship status has
been, and is being, challenged in 17 different legal actions in various federal and state courts, which
challenges cast doubt on the validity of the electoral process, regardless of outcome, if not resolved prior
to the certification of the election by the Electors. SOS is specifically charged with certifying and
guaranteeing the validity of official documents and overseeing the elections in California, such that the
people’s confidence in the fundamental aspect of democracy is maintained. To date, in this regard, SOS
has not carried out that fundamental duty.
69. This writ requests a court order barring the SOS from both certifying to the Governor the
names of the California Electors, and from transmitting to each presidential Elector a Certificate of
Election, until such documentary proof is produced and verified showing that is a “natural born” citizen
of the United States and does not hold citizenship in Indonesia, Kenya or Great Britain. In addition, this
writ requests a court order barring the California Electors from signing the Certificate of Vote until such

documentary proof is produced and verified showing that Senator Obama is a “natural born” citizen of
the United States and does not hold citizenship in Indonesia, Kenya or Great Britain.
70. Should Senator Obama be discovered, after he takes office, to be ineligible for the Office
of President of the United States of America and, thereby, his election declared void, Petitioners, as well
as other Americans, will suffer irreparable harm in that an usurper will be sitting as the President of the
United States, and none of the treaties, laws, or executive orders signed by him will be valid or legal.
71. 3 United States Code (U.S.C.) Section 8 provides, “The electors shall vote for President
and Vice President, respectively, in the manner directed by the Constitution.” This federal statute confers
upon each elector an affirmative duty to discover whether the candidate for President for which the
elector is seeking election is a “natural born” citizen. Otherwise, the elector would not know if his vote
was being cast in the “manner directed by the Constitution.”
72. Given this constitutionally mandated duty, PETITIONERS have standing to bring this
Writ before this Court.
73. A growing number of questions have arisen in litigation in at least 10 states contesting
whether Senator John McCain or Senator Barack Obama are “natural born” citizens and, therefore,
constitutionally eligible to be entrusted with the Office of President of the United States. In the litigation
against Senator Obama, allegations have been made that his admitted dual citizenship in Indonesia, and
lack of evidence that he renounced the same, caused a loss of his United States Citizenship as a matter of
law. Moreover, evidence released by the Obama campaign purporting to be a “Certification of Live
Birth” on its face appears to be of questionable authenticity. One of the many problems with this
evidence is that the border design differs from the border designs of other Certifications of Live Birth
printed during the same time period. All these questions about both of the candidates are still unresolved.
In the course of those lawsuits, some of which have been dismissed, it has been determined that there
exists no designated official in the federal government, or the government of the states, directly charged
with the responsibility of determining whether any Presidential candidate meets the qualifications of

Article II of the Constitution of the United States. In most states, that responsibility is vested with the
political parties, all of which have a conflict of interest in making any such determination, and none of
which have been forthcoming with information or evidence verifying any candidate’s compliance with
the eligibility requirements.
74. A press release was issued on October 31, 2008, by the Hawaii Department of Health by
its Director, Dr. Chiyome Fukino. Dr. Fukino said that she had “personally seen and verified that the
Hawaii State Department of Health has Senator Obama’s original birth certificate on record in accordance
with state policies and procedures.” That statement failed to resolve any of the questions being raised by
litigation and press accounts. Being “on record” could mean either that its contents are in the computer
database of the department or there is an actual “vault” original.
75. Further, the report does not say whether the birth certificate in the “record” is a
Certificate of Live Birth or a Certificate of Hawaiian Birth. In Hawaii, a Certificate of Live Birth
resulting from hospital documentation, including a signature of an attending physician, is different from a
Certificate of Hawaiian Birth. For births prior to 1972, a Certificate of Hawaiian Birth was the result of
the uncorroborated testimony of one witness and was not generated by a hospital. Such a Certificate
could be obtained up to one year from the date of the child’s birth. For that reason, its value as prima
facie evidence is limited and could be overcome if any of the allegations of substantial evidence of birth
outside Hawaii can be obtained. The vault (long Version) birth certificate, per Hawaiian Statute 883.176
allows the birth in another State or another country to be registered in Hawaii. Box 7C of the vault
Certificate of Live Birth contains a question, whether the birth was in Hawaii or another State or Country.
Therefore, the only way to verify the exact location of birth is to review a certified copy or the original
vault Certificate of Live Birth and compare the name of the hospital and the name and the signature of the
doctor against the birthing records on file at the hospital noted on the Certificate of the Live Birth.
76. An unprecedented and looming constitutional crisis awaits if a President elected by the
popular vote and the electoral vote does not constitutionally qualify to serve in that capacity. In addition,

if Senator Obama is not a “natural born” citizen and not eligible for presidency, Senator Obama will be
subject to the criminal Provisions of the California Elections Code, stating, “Any person who files or
submit for filing a nomination paper or declaration of candidacy knowing that it, or any part of it, has
been made falsely is punishable by a fine not exceeding one thousand dollars ($1,000) or by
imprisonment in the state prison for 16 months or two or three years or by both the fine and
imprisonment” (California Elections Code § 18203). Further, Senator Obama, SOS, the Governor of the
State of California, and all of the California Electors may be subject to the penal provisions of the
California Elections Code which states, “Any person who commits fraud and any person who aids or
abets fraud or attempts to aid or abet fraud, in connection with any vote cast, to be cast, or attempted to be
cast, is guilty of felony, punishable by imprisonment for 16 months or two or three years” (California
Elections Code § 18500 ).
77. The Twentieth Amendment to the United States Constitution provides, “if the President
elect shall have failed to qualify, then the Vice President elect shall act as President until a President shall
have qualified; and the Congress may by law provide for the case wherein neither a President elect nor a
Vice President elect shall have qualified, declaring who shall then act as President, or in the manner in
which one who is to act shall be elected, and such person shall act accordingly until a President or Vice
President shall have qualified.” Thus, if Senator Obama cannot take office due to his citizenship,
succession to the Presidency is set.
II
BACKGROUND OF THE CASE
78. The Office of the Secretary of State of California is the California agency responsible for
certifying candidates for inclusion on the ballot. Historically, California Secretaries of State have
exercised their due diligence by reviewing necessary background documents, verifying that the candidates
that were submitted by the respective political parties as eligible for the ballot were indeed eligible. In
1968, the Peace and Freedom Party submitted the name of Eldridge Cleaver as a qualified candidate for

President of the United States. The then SOS, Mr. Frank Jordan, found that, according to Mr. Cleaver’s
birth certificate, he was only 34 years old, one year shy of the 35 years of age needed to be on the ballot
as a candidate for President. Using his administrative powers, Mr. Jordan removed Mr. Cleaver from the
ballot. Mr. Cleaver unsuccessfully challenged this decision to the Supreme Court of the State of
California, and, later, to the Supreme Court of the United States. Similarly, in 1984, the Peace and
Freedom Party listed Mr. Larry Holmes as an eligible candidate in the Presidential primary. When the
then SOS checked his eligibility, it was found that Mr. Holmes was similarly not eligible, and Mr.
Holmes was removed from the ballot. Currently, we have a similar situation in that the Democratic Party
has submitted the name of Senator Barack Obama as candidate for President.
79. However, there are a number of separate reasons that would make Senator Obama
ineligible to serve as President of the United States. On August 21, 2008, Mr. Phillip J. Berg, former
Deputy Attorney General of the State of Pennsylvania, filed a legal action against Senator Obama and the
Democratic National Committee. With his action, and in the subsequent appeal to the Supreme Court of
the United States, Mr. Berg provided documents to the effect that Senator Obama was born in what is
now Kenya (the British East African Protectorate of Zanzibar at the time) and that his paternal
grandmother was present at his birth. Senator Obama claims that he was born in Hawaii. According to
statements made by his half-sister, Maya Soetoro Ng, he was born in Kapiolani Hospital in Hawaii.
According to his biography posted on Wikipedia, Senator Obama was born in Queens Hospital in Hawaii.
However, he has never provided the original hospital birth certificate from 1961, with the name of the
hospital and the name and the signature of the doctor in attendance. All that Senator Obama has posted
on his website is a Registry of Live Birth (short version), obtained in 2007, that does not provide the
name of the hospital or the doctor. Clearly, one human being cannot be born in three different places.
Hawaii Revised Statute 338-178 allows registration of birth in Hawaii for a child that was born outside of
Hawaii to parents who, for a year preceding the child’s birth, claimed Hawaii as their place of residence.
The only way to know where Senator Obama was actually born is to view Senator Obama’s original

birth certificate from 1961 that shows the name of the hospital and the name and signature of the doctor
that delivered him. From August 21, 2008, for over two months, Senator Obama has refused to provide
his original birth certificate, even though, in his book, Dreams of My Father, page 26, he states, “… I
found the article folded between my birth certificate and old immunization records…” which shows that
he clearly has his birth certificate, or that he lied in his book. Particularly telling is the fact that not one
single person has come forward, not a doctor, not a nurse, not a hospital administrator, nor anyone else, to
state that he or she was present during this birth, except for Obama's paternal grandmother, who affirmed
that she "was in the delivery room in Kenya when he was born Aug. 4, 1961.” Additionally, when Mr.
Berg served subpoenas on the hospitals mentioned above, Senator Obama refused to sign a consent form
that would allow the hospitals to release any of his information. Instead, Senator Obama has hired three
law firms to defend himself, and has challenged the action by Mr. Berg on a technicality, claiming that an
ordinary citizen does not have standing to bring the suit. This matter is currently being reviewed by the
U.S. Supreme Court. The parties in this case have standing to bring this litigation, due to the fact that Dr.
Keyes and Dr. Drake, Sr., are candidates on the California ballot for President and Vice President of the
United States, and Mr. Robinson is an Elector for the Keyes-Drake ticket, and Vice Chairman of
America’s Independent Party, of Fenton, Michigan, which nominated Dr. Keyes for President. He is also
a Chairman of the American Independent Party (California), which nominated Dr. Keyes and Dr. Drake
for President and Vice President, respectively. Based on the foregoing, it is imperative for SOS to be
provided proof that Senator Obama is a “natural born” citizen.
80. If he was born in Hawaii, there are four (4) other obstacles to Senator Obama’s
eligibility. In and about 1967, Senator Obama moved to Indonesia, took the last name of his stepfather,
Soetoro, and went by the name Barry Soetoro. In original legal action filed by Mr. Berg, he presented
Senator Obama’s school registration, showing him registered as Barry Soetoro, Citizenship-Indonesian,
Religion Islam, signed by L. Soetoro. From 1945, Indonesia has not allowed dual citizenship and,
therefore, Ms. Dunham-Obama-Soetoro, Senator Obama’s mother, had to relinquish her son’s U.S.

citizenship in order to obtain Indonesian citizenship for him, which would make him ineligible to become
a United States President. Additionally, the United States could not allow dual citizenship with Indonesia
at that time, as Indonesia did not allow dual citizenship, and it was prohibited by the Hague Convention
of 1930, as interfering with the internal affairs of another sovereign Country.
81. In addition, upon return to the United States in and around 1971-1972, Senator Obama
would have been required to go to the then current immigration procedures to regain his U.S. citizenship.
There is no record of him ever doing that. Even if he had done so, he would be considered a naturalized
citizen and not a “natural born” citizen.
82. Additionally, assuming Senator Obama was born in what is now Kenya, at the time of
Senator Obama’s birth in 1961, (now) Kenya was the British Protectorate of Zanzibar and Senator Obama
was automatically accorded a form of British citizenship under Section 32(1) of the British Nationality
Act of 1948, effective date January 28, 1949, based on his father’s citizenship.
83. Finally, in 1981, Senator Obama traveled to Pakistan, when there was a ban for U.S.
citizens to travel to Pakistan. The only logical possibility for him to do so was by using one of his other
passports: Indonesian, Kenyan, or British.
84. Based on all of the above, it is the duty of the SOS to obtain proper documentation of
Senator Obama’s citizenship to confirm his eligibility for the office of the President of the United States.
85. On October 25, 2008, SOS was contacted, via e-mail, by Orly Taitz, Esq., discussing the
issues mentioned above. SOS has acknowledged receipt of said e-mail and sent a response. As of that
time, SOS was on notice and had a duty to act. Ms. Taitz had a subsequent conversation with the election
analyst of SOS Office, Ms. Philly Crosby. Ms. Taitz requested an administrative hearing on the matter in
question. Ms. Crosby stated that she would discuss the matter with Ms. Bowen and SOS’ General
Counsel, Ms. Pam Giarizzo, and that Ms. Giarizzo would telephone Ms. Taitz to discuss the issue. Ms.
Taitz followed this conversation with a second e-mail, confirming all the details of the conversation. As
yet, SOS has taken no steps to request the necessary documents from Senator Obama. It appears that Ms.

Bowen is intending to certify Senator Obama, and to certify his Electors, and not protect the people of the
State of California by enforcing its laws. As a result of SOS declining to act pursuant to the above
described legal obligations, the only remedy is to request relief from the Superior Court of California, and
seek injunctive relief available to bar SOS from certifying the California Electoral votes until such
documentary proof that Senator Obama’s United States citizenship is produced.
III
EFFECT OR FAILURE TO GRANT INJUNCTIVE RELIEF
86. Failing to officially and publically validate the status of the citizenship claims of Senator
Obama will cast a pall of doubt on the election process and taint the election results themselves. A proper
inquiry into Senator Obama’s eligibility will not constitute a hardship on Senator Obama, and it will not
deny his voters the right to vote for him, since this very right is dependent on his eligibility for the office
as a “natural born” citizen. If Senator Obama is not a “natural born” citizen, and, therefore, not eligible to
serve as President, no hardship on him or any other Respondent can be shown. On the contrary, lack of
the relief that is prayed for will constitute an insurmountable hardship on the voters of the State of
California.
87. Failure to grant the relief sought would allow a potentially corrupted, fraudulent,
nomination and election process to continue. If indeed, Senator Obama knew that he is not eligible for
the presidency, he would be subject to California Election Code Section 18203, which states, “Any person
who files or submits for filing a nomination paper or declaration of candidacy that it or any part of it has
been made falsely is punishable by a fine not exceeding one thousand dollars ($1,000.00) or by
imprisonment in the state prison for 16 months or two or three years or by both fine and imprisonment”.
Additionally, he would be subject to California Elections Code Section 18500 that states, “Any person
who commits fraud and any person who aids or abets fraud or attempts to aid or abet fraud, in connection
with any vote cast, to be cast, or attempted to be cast, is guilty of a felony, punishable by imprisonment
for 16 months or two or three years”. Clearly it is imperative to vet Senator Obama's eligibility for

presidency and resolve this issue prior to the certification of the election results by the electors.
88. Failure to grant the relief sought, demanding that SOS be ordered to verify the
constitutionally required qualifications of Senator Obama not only allows, but promotes, an
overwhelming degree of disrespect for our Constitution and for our electoral process, and creates such a
lack of confidence of voters in the primary and electoral process itself, that it would confirm a common
belief that no politician has to obey the laws of this Country, respect our election process, or follow the
United States Constitution.
89. Petitioners Keyes and Drake will be irreparably harmed by being unable to compete in a
fair and unbiased election. Petitioner Robinson will be harmed in that he will not be able to perform his
duties as an Elector in voting for the candidate that is eligible to become the President of the United States
under the law. It is incumbent on SOS to enforce the eligibility requirements.
PRAYER
WHEREFORE, Petitioners respectfully prays:
90. That the court issue a peremptory writ in the first instance barring Respondent Secretary
of State of California, Ms. Bowen, from both certifying to the Governor the names of the California
Electors, and from transmitting to each presidential Elector a Certificate of Election, until such
documentary proof is produced and verified showing that Senator Obama is a “natural born” citizen of the
United States and does not hold citizenship of Indonesia, Kenya or Great Britain. In addition, this writ
requests that the court issue a peremptory writ barring Respondent California Electors from signing the
Certificate of Vote until such documentary proof is produced and verified showing that Senator Obama is
a “natural born” citizen of the United States and does not hold citizenship of Indonesia, Kenya or Great
Britain.
91. For Petitioners’ attorney’s fees.

Mike Carey, president of the Ohio Coal Association (OCA), today issued the following statement in response to just-released remarks from Senator Barack Obama about the nation's coal industry.

"Regardless of the timing or method of the release of these remarks, the message from the Democratic candidate for President could not be clearer: the Obama-Biden ticket spells disaster for America's coal industry and the tens of thousands of Americans who work in it.

"These undisputed, audio-taped remarks, which include comments from Senator Obama like 'I haven't been some coal booster' and 'if they want to build [coal plants], they can, but it will bankrupt them' are extraordinarily misguided.

"It's evident that this campaign has been pandering in states like Ohio, Virginia, West Virginia, Indiana and Pennsylvania to attempt to generate votes from coal supporters, while keeping his true agenda hidden from the state's voters.

"Senator Obama has revealed himself to be nothing more than a short- sighted, inexperienced politician willing to say anything to get a vote. But today, the nation's coal industry and those who support it have a better understanding of his true mission, to 'bankrupt' our industry, put tens of thousands out of work and cause unprecedented increases in electricity prices.

"In addition to providing an affordable, reliable source of low-cost electricity, domestic coal holds the key to our nation's long-term energy security - a goal that cannot be overlooked during this time of international instability and economic uncertainty.

Let me sort of describe my overall policy.

What I've said is that we would put a cap and trade system in place that is as aggressive, if not more aggressive, than anybody else's out there.

I was the first to call for a 100% auction on the cap and trade system, which means that every unit of carbon or greenhouse gases emitted would be charged to the polluter. That will create a market in which whatever technologies are out there that are being presented, whatever power plants that are being built, that they would have to meet the rigors of that market and the ratcheted down caps that are being placed, imposed every year.

So if somebody wants to build a coal-powered plant, they can; it's just that it will bankrupt them because they're going to be charged a huge sum for all that greenhouse gas that's being emitted.

Nominally he is a 58 year old Professor of Arab Studies at Columbia University intertwined in Palestinian causes. Outside the resume he has advocated and provided a legal argument for Palestinians fighting violent wars in Israeli lands, land which he still terms an occupation, putting him at odds with UN Resolution 181 in 1947/48 which established Israel and was supported by the United States. He has called for “reparations” to Iraqis for the Iraqi War.

There is some evidence that Rashid Khalidi served as a de-facto spokesman for Yasser Arafat’s bloody Palestine Liberation Organization (PLO), a charge which he denies. Yet whether official spokesman or surrogate, he has done the Palestinians’ bidding over a long career that has impugned Israeli sovereignty at every opportunity, even serving as a Palestinian delegate during the farcical Madrid conference in 1991.

His controversial statements reportedly caused Princeton University to pull back from a tenured position there. So he remains at the most liberal and (subjective assessment) anti-Jewish institute of higher learning in the nation, Columbia University.

LA Times Obama Video
The saga begins way back in April 2008 when the LA Times reported on an event starring exemplary citizens William Ayers and Rashid Khalidi, sitting side by side with Barack Obama. About the video, they mention in passing that Obama toasted the radical Khalidi, but they neglect to report what exactly he said. They do not report the context, the reactions, or the speech by Ayers in which a dutiful Obama presumably sat through nodding and smiling. The LA Times concludes rather cryptically that Palestinians have a “friend” in Obama.

It should be noted that Barack Obama and Rashid Khalidi are close friends, one of the few friends Obama has acknowledged from his life before 2006. His kids go to school with Khalidi’s and he has admitted a full understanding of his views in an earlier interview.

Now fast forward to October 2008 where the major media is beginning to ask questions in light of Obama’s known associations with anti-American radicals. Where is the video? Let’s see for ourselves. Even the famously liberal politico.com and their embarrassing Obama-yes-man Ben Smith has “encouraged” the video’s release. That should end the argument.

Yet suddenly the Los Angeles Times is saying today that the informant gave them the video on condition it not be released. They could write about the contents, but not release it. Anyone believe that excuse? It’s like your best friend giving you a porno tape but making you promise not to watch.

What the LA Times did say at the time about the Obama Khalidi video:

The warm embrace Obama gave to Khalidi, and words like those at the professor’s going-away party, have left some Palestinian American leaders believing that Obama is more receptive to their viewpoint than he is willing to say.

One speaker likened “Zionist settlers on the West Bank” to Osama bin Laden, saying both had been “blinded by ideology.”

The Times claims in typical liberal fashion that they have given the full story by, you know, writing about the video. The problem, of course, is they have given us a sanitized version of the encounter, putting the best foot forward. The Los Angeles Times has endorsed Senator Obama for president, so they are hardly to be trusted with damaging information.

I think what actually happened here is the publisher is now stuck between loyalty to biased staff and the news. His Democrat staff, putting their best foot forward for Obama, concocted an excuse to hide the tape. Now the poor publisher has to protect the chastity of his staff or acknowledge they are acting like Obama embedded reporters. He knows the video is news. Give him credit for that. The junior reporters and their apologists in the newsroom are to blame for this conspiracy. Conjecture of course, but can you do better?

Rep. Barney Frank (D-Mass.) said Democrats will push for a stimulus package after the November election, and called for a package reducing defense spending by 25 percent while saying Congress will "eventually" raise taxes.

Frank told the editorial board of the SouthCoast Standard-Times that he wanted to reduce defense spending by a quarter, meaning the United States would have to withdraw from Iraq sooner.

"The people of Iraq want us out, and we want to stay over their objection," he said. "It's extraordinary."

Frank also said the post-election stimulus package will focus on spending for building projects, extending unemployment benefits, and further supporting states' healthcare costs. "We'll have to raise taxes ultimately," Frank said. "Not now, but eventually." Frank told the Standard-Times that if Democrats cannot secure the votes they need in November, they will try again in January, when they will likely have stronger majorities in the House and Senate.

Frank, the Chairman of the House Financial Services Committee, was an instrumental figure in engineering the bailout legislation to the U.S. financial industry, and indicated a new package may seek to ameliorate fears about investing. "The psychological problem is even worse than the real problem," Frank said.

Military Prefers McCain

A poll by the Military Times newspaper group suggests that there is overwhelming support for John McCain among U.S. troops in every branch of the armed forces by a nearly 3-1 margin.

According to the poll, 68 percent of active-duty and retired servicemen and women support McCain, while 23 percent support Barack Obama. The numbers are nearly identical among officers and enlisted troops.

The Military Times, which publishes the Army Times, Navy Times, Marine Corps Times and Air Force Times, polled 80,000 subscribers from Sept 22 to Sept. 29. The non-scientific survey gathered 4,300 respondents -- all of them registered and eligible to vote.

A racial divide was immediately evident among the respondents. Nearly eight in 10 black servicemembers chose Obama, while McCain captured 76 percent of white voters and 63 percent of Hispanic voters.

Numbers among men and women respondents were also visibly different. Men overwhelmingly said they would vote for McCain, 70 percent to 22 percent. But among women the margin was much closer: 53 percent support McCain, while 36 percent support Obama.

U.S. troops also said in the poll that they prefer McCain to handle the wars in Iraq and Afghanistan -- 74 percent said McCain would perform better, while just 19 percent said Obama would.

Four years ago the Iraq War was the single most important issue on which the military voted. But the war now ranks third in importance to these voters. The most important issue among the respondents was character (42 percent), followed by the economy (25 percent) and the Iraq War (16 percent).

There was a racial divide on these issues, as well. Black servicemembers said the economy was the No. 1 issue that affected their vote, and white troops said character was paramount.

The Military Times offered certain caveats for its poll, which was open only to its 80,000 subscribers. Responses were entirely voluntary and were not focused on a representative sample of the public, as scientific polls are. The troops polled were also somewhat older than average enlisted servicemembers and included more officers than is representative of the military as a whole.

Yet judging by the numbers, it appears that the Democratic party has not made many inroads into the traditionally Republican military.
